    Angry VWP..... Poor service

    Poor service from Vauxhall World Parts

    Was browsing their website on 4th march and bought a fuel pump for my 2.2 dti for little over £10....... obviously a misprint on the website, but never the less I ordered and paid for it.

    To this day nothing has arrived and I've just logged in and they have cancelled the order, but didn't send me a email to inform me of it being cancelled.

    I don't even know if they have put the money back in the account yet till I check with a statement.

    Don't think I'll be using them again just out the fact that they never even had the decency to email and say it had been cancelled and why.

    I think you may have some comeback there as you have proof of a competed transaction. Not sure but it might be worth chasing up if you want to get the pump for cheap?

    Thats not the case, if they have made a mistake they can cancel the transaction as long as they have'nt take any money from you.

    It is very poor service if they did'nt even bother to contact you.

    Even if they have taken money they don't have to honour it. The contract is generally finalised when a product is dispatched not when an order is received. Take a recent example where tesco has listed iPad for £50. Everyone got a refund and no iPad. Tesco did send an email though.

    I wouldn't necessarily be too harsh on VWP since you obviously entered into the transaction knowing the price was probably an error.

    In contract law, the contract is finalised when the payment has been received (known in legal terms as "consideration"), after that it is a breach of contract if the goods are not supplied within the terms agreed within the contract.

    Thre must be a condition in the "Terms & Conditions" that they are not obliged to fulfill the contract if the price has been mistated or the item is out of stock.

    However I do agree an email to say sorry there was a price error should have been sent.

    They have to sell it at the price advertised or withdraw them from sale, if they haven't withdrawn the item from their website then you should be able to get it at the price advertised.

    Sorry Ben5on with online orders they are not obligated to supply. Contract is finalised on dispatch not on order.

    Since the contract hasn't been crystallised by both parties yet, there is not a contract to breach yet as such.

    This is the same as the Tesco fiasco and the Ipad... they don't have to sell the item for the advertised price at all, as this is clearly a misprint then I'm sure it will be amended. Don't think there will be much you can do about tbh
