    Default Parking on waste land

    Hi all,

    Want to run something by you all here to get your take on it...

    I work int he city centre of Glasgow where parking is a premium. My work has no car park I can use so I use a pay and display open car park some distand from my office at a cost of £3.50 a day (approx £800+ a year).

    Recently some of the land arround our office which up till now has been waist land covered in rubble etc has been cleared. (this is becuase the land had planning permison for offices and progress has to be seen on the land to keep the planning permision valid... That said
    as the fiancial climate is so bad there is no likley hood of it being worked any time soon...)

    The land is now very smoothe and looks prime for a bit of cheeky parking which no one has been brave enough to do yet... Until today...

    A single car has parked on it and this has got me thinking... Should I also take advantage of it and park there? I know its private land but I would not be stopping or obstructing anyone if I did take a punt on using it.

    What's your guys thoughts on this....?

    I can't see the pics you've posted but that will be due to the pc im accessing the forum on. I would say that as long as you are not opening any gates, or avoiding any obvious signs to stop access then go for it. It might be worth checking that there are no signs up saying that clamping is in progress, although from what I understand the law in Scotland is a bit tighter on clamping cowboys anyway! I'd say go for it!

    as there is no signage to warn of parking enforcements they can't clamp you- however there may be other actions they can take if they have put NO TRESPASSERS signage up.... I.E they fence you in then tell you that you have no right to enter the land to retrieve your car etc..............
    looks like a good site for travellers though lol

    if it's private land ,

    might they have the right to remove your car anyhow they see fit ,

    i.e. = roughly and causing damage to your car ,

    you might come back to smashed windows , as it's waste land , kids might use it as target practice ,

    they might have the right to refuse you entry to the land for you to retrieve your vehicle ,

    One day the development might start while you're at work and your car may be classe as rubbish / junk left abandoned on the site , so they bin your car .

    if everyone starts doing it the parking officers or police will get interested.
    To get onto this do you have to drive over a pedestrian walkway?
    I ask this i had a parking ticket for parking on a grass verge close to a pay & display car park.
    When i questioned the copper why i had a ticket as the previous week the verge was full of cars.
    (His smug reply was "must have been my week off")
    He then went onto say if you like we can go into "you driving over a pedestian walkway, which is also an offence")
    Just be careful is all i say. they dont like loosing money.

    Also , How much do you love your Vectra ?

    are broken windows or a retrieval charge from a car pound or any damgage worth you not paying £3.50 a day ?

    Would your insurance pay out for damage caused on private land , you wrongly parked on ?

    On the other hand you might get away with parking on the waste land for months ,

    Before any trouble starts , but then it's just a waiting game ,

    can you live with thinking , evertime you go back to the car ,

    Will it still be there ?

    Will it be damaged ?

    himmmm...

    Think I will chance it tomorrow and see what happens.

    My offcie is where the photo was taken from and I can see the car from my desk so could technicaly run out if needed. The building right next to it (top left) belongs to the MOD and has security patroling the grounds. Makes this are faily safe and fee of kids at all times lol....

    Things are different in scotland also. It's ilegal to clamp here full stop. There must also be signage advising of no parking which there isnt here...

    I suppose the land owners could sticker me but that's about it I think...

    if there are no wheel clamping warning and etc i would go for it.. As far as know and as mad as it seems trespassing is not actually a crimial offence in the UK, breaking and entering is of course but if the access is not blocked that is not what you are doing..

    We have a couple of five O on here and they should be able to offer some clarity or correct me if my info is wrong.

    I was thinking that as you're in Scotland, the civil trespass laws are different to England and Wales too.

    As it's semi-developed land in a city, it's not covered by the Scottish Land Reform Act (which basically says if it's not fenced off or in use, you have the right to pass through as long as you don't cause any damage).

    So technically it would still be trespassing same as in England, but this is a civil offence and you have to be formally asked to move first, then a court order obtained to stop you parking there, and if you did it again you'd be breaking the court order, which is a criminal offence. At this point the Police can come in and remove you/your car by force as a crime is taking place.

    Up to you as to whether you risk it really - I suspect if the landowner gets wind of it, they'll send some heavies down to remove the cars by just towing them over the loose surface. Because the cars are on their land, they can legally move them off it (but as you say, they can't clamp them).

    Wow I break the law every day in that case just to get into and out of my house/land. Any no parking signs? Think he's being a nob TBH.

    Police eh?
