    Default Car insurance write off help/advice

    My brother inlaw brought an astra for £6k, 4 months later someone crashed into it out side his house. Police have done woman for carless driving. BUT his insurance company have offered him £5k for the car minus his excess (until claim is settle via her insurance) and minus his remainding 8months insurance which was £900 (first car)
    Question is can they take his Years insurance??? It wasn't his fault? Or will this also get refunded?
    We can't get any sence out of elephant.

    yes in the event of a claim if your paying monthly the remainder of the years premium need paying before a claim will be paid, or deducted off the payout.

    Even though he wasn't at fault? That sucks, badly!!! Can people claim it back as an out of pocket expense ?

    This is how it works - your BIL entered into a contract with his insurer - he pays them a year's premium, they'll pay any valid claims he has during the next 12 months. They've upheld their end of the contract - paying the claim - and they expect your BIL to uphold his end of the contract - i.e. pay the year's premium. If he's going to get a cheque for his written off car, why doesn't he buy a replacement car and put it on the same policy he already has; that way he's not paying the rest of the premium for nothing.

    So as long as he gets another car pit onto that policy he could use same policy and just change the details and pay the difference if there is any?

    But what if will be looking for a replacement car for let say 3 months (maybe he wants something rare)?He will the lose those 3 months of premium.Not fair
