    Default log book question

a friend of mine had a cheap car bought for her by her boyfriend at the time.

they have now split up and he has said she can have the car and he put her name on the logbook to make it all legit.... thing is now is he's kept the logbook over a daft argument and she wants to sell the car so what can she do?

i think that as its in her name, all she has to do is get a duplicate but im unsure if thats right.

You would think the name on the log book indicates who the owner is, but, unfortunately theres now a notice on the front of the log book document, it says in big writing that it isnt proof of ownership..

Unless they work it out themselves, I guess she may have to take legal action to get the car back.. Or has she still got the car and keys? If she has then yes, I suppose she could just apply for a new log book then flog it on.. Better if they work it out though eh...

Then she should either work it out with him and get the log book, or get a new one.. If he claims its his car though, and can prove ownership with a purchase receipt or something like that, then I guess it could get quite messy and complicated..

indeed its a civil matter ... the proof of ownership as stated on the front disclaimer is more based towards finance companies etc.......BUT its not going to be sorted overnight if she hasnt got written confirmation that the ownership of the car was to be transferred ... even then the burden of proof regarding ownership still needs to be proved as if he decides to report the car as "stolen" and she's pulled she will have a hard time providing her case at the roadside with an officer ....

the ownership was transfared as he put her name on the log book..

he's just being awkward by keeping the lb but it looks like she'l just have to get another copy.

    cheers all.

Ahhh, sorry I misunderstood, I thought he was wanting the car back.. Ok, yea, as others have said, if she cant work it out then obtaining a replacement log book is easy enough.. Best just saying its been lost rather than that some dude is holding onto it..
