    Summary is a guy on VXR online was racing this dude on the road who unbeknown to him recorded the 'race' on his mobile phone.

    Sometime later, in a completely seperate incident, this dude crashes and kills 2 people.

    Police get his phone and find this 'race' video on it with the VXR owner some time later.

    VXR owner is now being prosecuted with phone 'video evidence'

    I'm not condoning street racing as it should be left to the race circuits and Santa Pod type venues.

    I'm more interested in the use of Mobile Phone Camera's everywhere. Where are the 'legalities' of video'ing someone else without their permission, human rights etc...

    Doesn't matter how the evidence is obtained if you ask me Like having to tell someone you're recording a conversation for it to be used as evidence - ridiculous IMO...

    but surely that means that he was using his mobile while driving

    That would never happen now, it's against the law, you're not saying people still use their phones whilst driving??????????

    just a shame the video was made that was the guys down fall and puting his hands up to it but and here is the but from what i just had a read of he was near on twice the speed limit as the vid showing the type r at 110 and he was well off in front so may well have been near on 130-140 ish thats a STUPID speed on public road never mind a motorway

    Public place, you can video almost what every you like. You cant invade someone's privacy by standing at their front window and taking a video in to their home but walking down the street you can, as long as you are not putting them in a state of fear or alarm(ie stalking them).

    There's plenty of instances of cases like this on the net, think the first case that came to light was the guy in Japan in the F40 who did nearly 200mph on the public roads, made a video of it and sold hundreds of copy's. Im sure he had his car confiscated. A few bikers fallen foul of this too.

    Only way around this for him I can see would be to deny all knowledge of this, say it wasn't him, it wasn't his car and let the police prove that his number plates weren't cloned, which they would struggle to do. Its up to the Crown to prove Beyond Any Reasonable Doubt that it was him, which without an admission or a picture of his face in the camera footage they will struggle to do.

    HOLY crap, that is a very very scary proposition, that recorded evidence in such an innocuous manner falls into Police hands has simply destroyed some guys life.

    It should be a reminder to all before going out to play, that Big Brother is watching,,,,,,,

    Excellent point m8. It's the same stupid law which means if you have CCTV at your home and don't put up a notice warning of it's presence. Someone could come along unmasked and vandalise or steal your car and the CCTV evidence would count for nothing in a Court if they were caught. What do they do? Cover up and do it.

    This country really needs to get a grip concerning human rights.

    Sorry spoons but if you (not just you, anyone in general) drive like a clown then you should suffer the consequence of your actions. As you say keep the racing for the tracks, so to me you have the answer as to why he was caught and why the evidence was used.

    You need notices warning of business use of CCTV but the Data Protection Act doesn't cover use of CCTV within a private household environment, so warning notices aren't required.
