Default Where do I stand with this? Selling a phone on contract.

    Hi people.

Right I have had an iPhone 3GS since November last year with constant signal issues. I've been given a replacement phone by the Apple Store in Liverpool One to try and sort it but the problem remains. So I have a brand new iPhone here that has been used for 5 minutes to see what the signal is like. Still the same.

I rang up 3 to tell them about it because in this area they simply don't supply iPhones with a good service. My old and well battered Nokia E71 on the same SIM card gets a near full signal. They wanted to extend the contract by 6 months and charge me £80 to change to another handset which is simply not on.

I've decided I'm going to stick with my old phone because despite being knackered, it works much much better and is more reliable. I've told 3 this and they said fine. So as it stands I have a brand new unlocked iPhone here not being used that I plan to sell.

Question is, can I actually sell it? 3 know it isn't being used and they have not asked for it back. I'm continuing to use my old phone. I don't want them to suddenly decide they want it back in 6 months time and me not have it.

    Cheers.

    Brilliant.

In that case my mates dad is having it, £250. Pretty damn good deal for a brand new unlocked iPhone.
