    Default Question for any police officers

    I was seen driving over the speed limit today and over taking

    Yes I've broke the law but can a off duty police officer do me for speeding or careless driving?

    Just been pulled by a community support car and questioned if I was on the road as I was seen by a off duty officer?

    About 15 years ago, i was reported by an off duty police officer on the A303 just outside Andover at about 10pm.

    A knock on the door about 11.30pm by a Police officer... Asked if i had been on the A303 at around 10pm, which i was, where he told me it had been reported that i was driving erratically.. which i dont think i was.

    This follow up was to ascertain that i was the legal owner of the car. As there was no proof that i was driving erratically, he could take no further action. I guess in those days they didnt have access to databases to check docs etc.

    I would say that if there is no proof even in this day and age, it would be difficult to take any action... as it would be his word against yours

    the long and the short of it is than you can be reported for an offense as such ....

    that your driving falls far below the minimum acceptable standard expected of a competent and careful driver; and it would be obvious to a competent and careful driver that driving in that way would be dangerous.

    the offense could have been reported by anyone not just a police officer you could walk into a police station or phone to make such a complaint about anyone ...

    the crux lies in the evidence ... can his report be corroborated by another person/independent witness as the case still needs to be proved beyond reasonable doubt in a court of law

    the question is though how would they have known that you were driving over the speed limit unless you were excessively over the speed limit ??

    i've previously been in court having made such a report and with another officers statement that we both believed the vehicle was speeding excessively in a built up area ....we estimated the speed at in excess of 50 in a 30 limit (by the sound and perception of speed based around other vehicles on the road at the time in question) this was held up in court and the person recieved points for dangerous driving

    If off-duty, then why was the officer in a police car?

    As previous, speeding needs corroboration (witness or device, but differs slightly in Scotland)

    Equally, the officer would know that a caution at the roadside would normally be required
    Sounds more like the officer saw an offence, served a verbal warning, end of matter

    Finally, why did the officer question you about being "on the road?
    Surely, you are either on the road or not?
