    Default Sold a car privately advice required

    Hi Guys,

    Hoping you can offer me some advice , i have just sold the wifes car on fleabay (£600 banger)and the guy who has bought it wants to come up from Surrey (to Newcastle) and collect it , take it to a garage an drive it back. Now this would be fine but the car is currently SORN and has no MOT or TAX, I cant let him drive it to the garage can i ? if i do and he gets pulled it would be me in the Sh!t.

    Also it needs a new instrument panel as all the dials are knackered so i presume the replacement part would take days to come , the guy says he is staying overnight.

    its a £600 banger why would you incur trainfares and overnight stays for it then hope the garage can fix it same\next day , if they cant is he gonna spend on yet more train fares?

    It states on my ebay ad that it needs to be trailered away

    What should i do ?

    write two copies of a receipt out stating its sold as seen , list the faults he knows about and state its got no tax or mot and that he knows this

    get him to sign date AND TIME the reciept and you sign as well

    should be no come back from that

    If its on a SORN and has no tax or MOT he cannot drive it, I wouldn't think it was legal to drive without dials either. He would probably find it cheaper to get the car transported.

    Cheers guys, really not sure i should let him drive it away at all even if i do the v5 docs etc its still "my" car until the dvla update their database.

    if the police pulled him what would be their proceedure ?

    hi guys he says he has it booked into a garage nearby (ish) for repairs i have told him it cannot be driven without tax but he seems to be ignoring that fact he has said he is happy to cancel the purchase if i am not happy with his plan. Think i might just do that as it seems like he's happy to drive it with no tax. Would i get screwed for fees from fleabay we mutually cancel the transaction?

    Alternatively i could get him to sign something like below but i'm not sure it this would stand up should he get pulled or whatever :-

    Don't let him drive it. Simple until he signs a reciept. After all you have told him it needs to be trailored, and if he's stunned when you tell him it's a SORN and has no Tax/MOT then say 'I told you it needs to be trailored.' It was his responsibility to ask why it can't be driven.

    If he drives it and crashes/has an accident, and you haven't had papers signed then it comes back to you as he can say he was only test driving before buying.
