    Default Legal help, Where do i stand with a 'trade sale'

    As you may know (or not), had my 1.9 cdti for less than 2 weeks and discovered that the swirl flap linkage had come off.....and vauxhall want to charge me £1000+ to fix it. So sent them a nice email to get the ball rolling.....

    Was telling someone my problem and the first thing they asked was have i spoke to the garage i bought it from. I havent because it was a 'trade sale' and thought i didnt have any come back, looks like the term 'trade sale' means diddily squat.

    Bought it from a 'motor group' main dealer who had obtained the vectra in part exchange. They said it had a premium vehicle check which involves 'a series of rigorous checks by qualified and trained people before you take delivery', Cant be that qualified if they cant spot the linkage lying on its side!

    So basically i need your advice on where to go from here

    Wherever you buy the vehicle from it needs to be "fit for purpose" if this is not so, then you have a case to argue

    Was the sale price subject to VAT?
    If so, then it was a commercial purchase and many of the retail laws do not apply (as they would for a retail purchase)

    I payed an agreed price......just found this though:

    attempting to get around these regulations by calling a sale that obviously is not, a "trade sale". A "trade sale" implies that the customer is a trader with some knowledge of the car trade who is buying the car to re-sell. In reality this phrase is meaningless. It is not possible for two contracting parties to agree to avoid the effects of the consumer protection legislation (even if they wanted to). Obviously, if the car is sold to an ordinary private individual at a retail price, then its status as a "trade sale" for legal purposes needs to be challenged and precedents set in the courts to guide judgements in other such cases.

    speak to trading standards matey... write a letter to the dealer explaining the situation & allow them 14 days to make good or offer a refund

    Trade sale normaly means you buy it as is without any come back as being 'Trade' you have checked it over 100% and 100% happy with it.

    Trading standards have a different opinion on that mate... I'm helping my sister out who got stuffed by being sold a shed by a trader in Leeds
