If it's under 3.5 ton GVW, then you don't need a tachograph fitted.

You only have to use a tacho if the vehicle is being used for business, profit or gain. This is how fairground companies get round it.....

I would say that if the total weight (inc trailer) is over 3.5T then you need a tacho.

If the vehicle in question is not being used as a commercial vehicle then you are not subject to the EU drivers hours limits and regulations.
However, some other information that may be of interest to you all,is that all new commercial vehicles are fitted with the new digital tachograph which requires the driver to hold a "Digi card",which can be obtained, for a fee, from the DVLA at Swansea,if they intend to use the vehicle commercially.(This will include Transit Vans, and all similar type vehicles!!,and, even if they are not going to be used commercially they will still be governed/restricted and subject to the same speed regulations that HGV'S are required to observe).I am not absolutely sure of these particular details relating to the national speed limits on A roads or dual carriageway's,but if it is the law on Motorways then it's going to be 56mph or 80kph folks!!.
I would suggest that if anyone that has any queries relating to this issue, that they either contact their local police traffic unit or contact VOSA,who have a website with all the relevant information on.FELIXX.
