    Default private parking co. ticket

    got a ticket for "not being in the space correctly" there were no lines marking the space just those square metal plates set in the floor as it was raining i didnt notice them. should i pay the 30/60 pound ticket or ignore it as it was on private land (university car park),have been told it is rare they follow these tickets up as far as court as it is a civil matter and something about contract disputes? any advice welcomed,thanks

    Car park "road markings" do not hold any legal recognition
    They are advisory only
    Enforcing them is just not possible; I've yet to hear of one case which has been accepted by a court

    I suggest you take photographs of the entire car park, if possible the space you used, and an example of how your car was parked in that space

    Equally, how does an "oversize" vehicle park in such a space and not get a ticket?!?

    The usual advice is to either :
    pay the ticket under dispute, then proceed to small claims court for repayment
    or
    not to pay the ticket and defend the action in court (the method I use)

    i'm in sheffield uni was in bath,so no photo opportunity,the co.have photos of my car "incorectly parked"on their website plus pics of the warning notice etc i am tempted to say sod it and see how far they will go,thanks for quick response

    if its not on a public road and legally marked

    then

    its a civil matter.

    to be honest they need to prove you were in breach of their regulations.

    i'd not pay, ask for proof that this happened. can they prove you were there? photo?

    if not then i'd ignore and say you've no proof i was there, operator mis read plate etc

    Dont pay it they dont have a chance of getting money from you as it would cost them a whole lot more to take you to court and the court probably would decide against them.

    There was a recent case that went the "wrong way" for a private car park which makes it much harder for them to get any money out of you.

    They failed to prove that the person parking had entered into a contract and agreed to their terms and conditions simply by parking in a space, even though there was a sign nearby.

    Net result: they can try chasing you for the debt, but if you defend, they will probably give up.

    If it's a council car park, you are a bit stuffed, as different laws apply.

    had a barney with a private parking company who enforce the Aldi car parks.. I could not be arsed with the fight so a rang up to pay but made sure I thoroughly abused the person on the phone before i paid.. They annoyed me so i made sure i ruined his day and that made me feel much better.. I had read up about them on the net but most info was not very encouraging, many said don't pay but it was not a ticket in their name.. Those that had tickets were not have a goo experience and that what the company want it to be like.. However mine was for a 3 minute overstay on their 90 minute limit.

    This is not legally enforcable.
    Also any so called "contract" is entered into with whoever was driving, not the registered keeper. It is down to them to prove who was driving. They just pay the DVLA who gives them the name on the V5.
    Should it ever go to court, which I doubt, they can only claim for losses which in the case of a free car park is diddly squat.
    I would just ignore. You might get threatened with bailiffs but these can only be appointed by a court.
