By not finding the driver at fault in killing 4 people and imposing a proper sentence.

The driver is responsible for the tyre condition as well as his driving in such cold conditions. He was not driving carefully enough.

I knew one of those killed as we worked together for Quinton Hazell.

Four families suffered and just a £180 fine!!

With the greatest of respect, it is possible to have a car in perfect working order, drive extremely carefully and still have an accident.

The court concluded that the state of the tyres had no bearing on the accident. IMHO they are probably right. Black ice is extremely dangerous, because you can't see it as it just looks like wet road or a puddle, and it can appear in an unexpected spot. Even the best of drivers would find it difficult to control a car in these conditions.

I could be wrong, maybe he was driving like an idiot and there is a seperate case for that, but based on what is in the story I can understand the court's decision.

I agree 100% that £180 is pitiful for four lives, but there are such things as genuine accidents and the driver can't be punished if this is one of them.

Emotional subject, especially if you are personally involved, but after reading it I would agree with above, looks like a tragic accident ...(though theres no excuse for 3 bald tyres it didn`t have a bearing on the accident)

I rememmber this happening and seeing it in the local news. As I recall (I may be wrong) the driver was not driving at excess speed and was just "unlucky" with the Ice according to witnesses.

It is regretful and driving with dangerous tyres is no excuse.

Unfortunately as I understand it the law at present does not take deaths into account for motoring offences unless it was death by dangerous driving. That is due to change is believe.

It's hard to quantify an acceptible punnishment. This was a genuine accident that apparently could not have been prevented even with good tyres. Do you jail someone for surcoming to nature?

Whilst the four families are understandably grief stricken, and my sympathy goes to them, I reckon the driver is just as upset - he also has to live with it for the rest of his life, what ifs etc. From the reading the link it does seem like a horrible accident that anyone could have the misfortune to of been in. His tyres were a seperate issue it seems.

accident or not seems somewhat light as way of a fine, just think if it was a family member on a bike ride (or even in a car)and someone with defective tyres wiped them out would you be happy (I know I wouldn't be!) probably get a bigger fine on a normal stop for three bad tyres!!!

    only my opinion
