Angry sold a car now buyer coming back and says it faulty HELP

    Hi all,

sold a car privately this week. Lad who brought it came with a friend and viewed it and took it for an extensive test drive early this week, thrashing it as he did (I even asked him to slow down). He picked it up with his Dad today who also checked the car and went back to Coventry at 10am this morning. Just got a call from him at 1.20pm saying engine management light has come on and he has taken it into a garage who says it needs £300 spending on it. He cannot give me a code or tell me what the garage have said it wrong with it. It looks as he has thrashed the ******** off it on the way home. He is now saying he wants his money back! I am not going to give it back as we never had any management light come on at all when we had the car for nearly a year.

I have a receipt saying sold as seen. Does anyone know if he has any comeback legally?

I asked him time and time again if he was sure he wanted the car and each time he said yes. I am so and I do not want the car back after he has driven it as god only knows what he has done to it.

He was happy at the time of buying, he went over it as you twice, with 2 diffirent people at 2 diffirent times and was happy, so it's just the luck of the draw that if anything has then its just the way it goes.

I'd tell him that and tell him he is wasting his and your time ringing to get his money back as he wont be.

    Sold as seen mate,

But if there is a managment problem the garage will tell you what is worng, if he's been in , ask to speak to the garage to find out what is wrong, if he refuses there isn't much he can do I would think,

I'm sure someone will be along soon to advise of the legal stuff , but normally sold is seen , is just that,

He's ****ed it himself, or a liar

Private buyer would have to prove there was an existing fault you deliberately hid, or misled them on, to have any legal recourse. Of course there's no harm in them asking, but you have every right to refuse.

Given that they had two inspections and a thorough test drive, it sounds like they are just trying it on.

I'd be quite happy to point them in the direction of home and consumer direct to show them you have fulfilled your responsibilities.

Ensure that your payment, if anything other than cash, is cleared, otherwise you may end up in an awkward situation, if they cancel a cheque or bank transfer. You'd have no money and they'd have the car. In that case you need to be in touch with the police as this has dodgy written all over it.

"Sold as seen" means nothing in a transaction with a trader. And any phrase used means nothing in a private transaction, except "caveat emptor" - buyer beware.

Thanks for the above advise, have called Consumer Direct and they say he has no comeback as long as I did not lie about anything, which I didn't. They said not to worry and if I get any further issues then come back to them.

I feel bad in one way thinking I may have sold him a dodgy car but we never had any issues with the engine and it drove well. We got 50mpg out of it! I knew I was going to have problems when he drove the crap out of it on the test drive so it is his hard luck. We never had any engine management lights come on in the year we had it.

I have to agree with the others, Sold as seen is just that, however it is extremely regrettable when this happens as it leaves a sour taste and feels quite uncomfortable too.

Hold your position and demand that the car was twice inspected, he "drove it like he stole it" on the test and it left you in perfect working order.

Jeez I loath people like that.
