It seems this is the latest one on a failure sheet, anything that obstructs the view, stuff hanging from mirrors etc,, fails
They're not at liberty to remove "said item" either.

Failure.
If I test a car with a magic tree on the mirror, I take it off and put it on a piece of paper towel on the passenger seat and then just tell the customer I've taken it off. Satnav mounts, I ask the vehicle presenter to remove them before I test it.
Just before Christmas, my colleague at work tested a car. Satnav mount in the middle of the windscreen. He said to the customer, who had left the car with us but had returned just as Paul was entering the details onto the VTS device after finishing the test, that really it should have failed for that but he wasn't going to fail him cos it was petty, and in all other test areas the car was sound. As Paul was handing over the pass certificate, the VOSA traffic examiner walked in, introduced himself and asked for the car that had just been tested to be put back on the ramp so he could test it. Paul then received 20 points (once you reach 50 points you are suspended from testing, and may end up in court) for passing this car and was disciplined by work too. So, the tester isn't doing these things to be an awkward so and so, its cos he doesn't know if VOSA are sat 200 yards up the road, with a laptop logged into their VTS device to see what tests have been done or are being done right now. As soon as you log a test off, they're straight in.
BUT, I agree, the magic tree thing is a bit much and I for one will simply remove it.
