    Default Points on license

    Just asking for a mate, she jumped a red light in sep 07, she decided to contest it in court as it was 0.4 sec. Court case wasnt until april 08 and she was awarded 3 points. what she wants to know is when will her 3 points be invalid from, is it from the offence date or the conviction date. I think it will be from the offence date but tbh i'm not sure. Does anyone else know?

    My other car. 1972 1641cc slammed beetle. On the road finally!!

    i believe its from the date of conviction as the sentence wasnt handed down till then...

    It depends on the offence code used to endorse the licence, following conviction.

    Some points run from the date of offence, others from the date of conviction.

    Was it TS10 in this case?

    i asked this dvla, i got done on the 4th may 2006 but went to court on the 4th auguest 2006 so i thought the points will stay on till auguest 2010 (4years) dvla told me its 4 years from the date when you did the offence so i have a clean licence now

    Not sure what the code is, i'll have to ask her. As far as i'm aware, it was just not stopping for a red light.

    was it one of them cameras on the lights so if you run a red it gets you? theres 1 by me and i dont even chance it

    In Germany i ran a red light something like 0.34 secs - they took my license from me for a month

    If the 3 points are likely to take her to the point where she would lose her licence then the the points date is always taken from the date of the offence. Earlier points in the totting up system are from the date of conviction.

    IOW the one which would result in your loss of driving licence is from the date of the offence.

    This was done to close a loophole many decades ago, to prevent people from simply claiming they were ill or any other reason so they could keep getting their case put back (delayed) until some earlier points came off.

    From what i know she had 6 points already, thats why she wanted to go to court to contest it as she didnt want to have 9 and have 'no lives left'
