Declaring cat c or d

Am I right in thinking that if you are aware that the car you are selling has been recorded as a write off then you should be saying so in your ads? Is this something that needs to be done by law?

(and yes I know you would need to prove it was known if buying and they don't say)

It is not a legal requirement to declare it but you are legaly obliged to declare it if asked.

I guess so unless you can find out when the car was last checked - I mean if it was in their possesion then they probably know, but as you say - prove it

As a private individual you must answer questions truthfully with regards to the vehicle's past and conditions, but you don't legally have to declare anything.

As a business you are required by law to declare everything, without even being asked; this applies to everything that you would reasonably expect a motor trader to know about a vehicle, finance, working parts, history, condition, mileage etc.

Any non-disclosure of information which would effect the transaction constitutes a breach of the consumer protection regulations and is illegal.

Common sense suggests you should be clear in the first place to avoid people wasting your time and theirs coming to look only to not buy as soon as they find out, or not be prepared to make an offer anywhere near your asking price. Or the hassle when you find yourself with a returning grumpy purchaser, who might just be not the sort of person you want to be peeing-off, who finds out the history when trying to get insurance...

A cat C vehicle has it printed on the V5 anyway saying that its been substantially damaged or repaired and a VIC test has been carried out.

The insurance companys have to inform the dvla about the insurance category and 9 times out of 10 they dont do it so its not recorded on the log book.
