points on licence

i have 6 points on my licence,

i got cort in may 2006 for no insurance ( i had insurance on my other car but not the 1 i was driving, my fault and very stupid i know) i went to court in August 2006 and they gave me the 6 points, i know its 4 years they stay on for, but will the 4 years be May or August?

tried to contact the dvla and they aint excepting calls today

In the normal points totting up system, I know for a fact that the first endorsments on your licence are dated from the court date, however the last endorsable offence (points) which would result in you losing your licence is always dated from the time of the offence.

This is done to prevent people from delaying or continually putting their case back perhaps for fictitious health reasons for example so previously imposed points can expire.

By dating the points (which will effectively ban you) from the date of the offence, it closes that loophole. In fact it was closed 30 yrs ago...lol

This happened to my son some years ago, he had accumulated 9 points due to speeding, the first set of points were due to expire the first week of May, however he got caught again towards the end of April, just a week before the other points expired. He thought he would be okay has the NIP came after the first points had come off, but no! he had to go to court to give reaon why he should not be banned under the totting up system. He was lucky, but because it would affect his business, he was fined £350 but allowed to continue driving.

So worth bearing that one in mind! Not many people realise this, but it's true, and when you think about it.... it makes sense, otherwise people with money would just keep arranging to have their case put back until previous points have expired.

The points are live for 3 years
The points remain in licence for 4 years
The pionts need to be disclosed, on request, for 5 years (even though not on licence, which raises other issues, "ie I can't remember")

Points stay on for so long, then expire but the offence stays on for longer.

Being over the drink drive limit is one where the offence stays on for 10yrs I believe.
