    Default carless driving question?

    a friend of mine hit a moped 5 months ago and was questioned and told he was going to be reported for carless driving, that was 5 months ago and still not had anything back from police or CPS? he knows the moped was speeding and de-restricted but police dont want to know and this was never followed up?

    Any way question is... do the police have a limited time to take my friend to court or serve a summons?

    If taken seriously they'd have been round in the first instance for a "chat" and to inspect the damage to the car. I suspect they thought it nothing more than a bog standard RTA for the insurance to sort out.

    The Police have a habbit of taking their time so your mate might not be off the hook just yet. But i guess 5 months is quite a long time.

    The time limit for this would be 6 months from the end of Police enquiries

    Assuming the driver was cautioned at the roadside then a prosecution is very likely
    The next step will be receiving details of the court date (the way this is processed is slightly different in Scotland)

    I would wait for 6 months from the date of offence, then contact the Police and CPS, and see if the case is proceeding
    Remember you need to contact the CPS in which the offence occured

    I had an accident involving a pedestrian a few years back, I was told I had nothing to worry about as the police on the scene felt that I had done nothing wrong, however one day through the door came my court summons. I believe I had that through around 3 months after the accident but would agree with the above comment that you should hear within 6 months....

    The moped rider is the one who should be done for "carless" driving - i.e. driving without a car. Your mate has to worry about his careless driving though.

    always worth paying £10 for legal cover i reckon. If he has cover get his legal team on the case of the uninsured moped - if its illegally modified his insurance will be invalid. Probably a breach of his licence conditions too. If not pay for the cover next year and keep his fingers crossed.

    Wish i could find an insurance company that only charge £10 for legal cover. I searched for car insurance last month and most legal cover polices was about £24 - £ 27.

    decent insurance companies throw legal in for free anyway

    or if your in a union at work, you get free legal cover for everything

    Always make a no comment statement!!!, any statement you make will be used against you!!, A NONE injury accident is not a criminal offence and you cant be arrested for it and you don't have to make a statement!!, therefore if there are no other or limited reliable witness statements you will be unlucky if it goes to court. SAY NOTHING its your best defense.
