Default Speed limits & speed cameras.

At the risk of opening a great can of worms, or starting a mega argument, it may be helpful if any, more experienced people than myself, especially Police Officers, could offer any useful information regarding speed limits & speed cameras, the reasons they're there and the likely courses of action should anyone be caught speeding.

This information isn't required to enable any of us to evade punishment for committing a speeding offence, purely as a point of interest & to help keep all of us within the law, after all, points do not make prizes & i for one would like to keep £60 in my pocket!

    I've found a few sites/documents so far :-

    http://www.dft.gov.uk/pgr/roadsafety...yourlimits.pdf

    http://www.opsi.gov.uk/SI/si2002/20023113.htm

    http://www.abd.org.uk/speed_limit_signs.htm

    http://www.speedlimit.org.uk/

Again, i don't intend this to be a debate of the whys & wherefores of speed limits & cameras, just a source of info that hopefully we can all add to & use.

    Default

Firstly, the road has to have a traffic order on it

If the road is 40mph, or higher, then it must have repeaters at the correct maximum distance between them
If the road is 30mph and not illuminated by street lighting then it must have repeaters at the correct maximum distance between them

If the road is a "principle road" then the terminator signs must be illuminated AND in working order

If the road is a "special road" (the legal definition of a Motorway) then it does not require to have repeater signs, unless the speed limit is less than 70mph

To determine if a road is a "principle road" you need to contact the local authority, but do not ask if the road is, simply ask for a list in their area
If the road is not listed then it can be assumed that it is not

Remote speed detection devices must be Home Office Type Approved AND hold a current Type Approval

Manual speed detection devices only require training in their use, no Home Office Type Approval is required
Where appropriate, ACPOA guidelines in their use must be followed correctly, the manufacturers manual takes precedence

Speed detection does not require to be visible to the road user
Where the speed detection is supported by a Safety Camera Partnership, then providing their guidelines are followed, the "revenue" remains within te partnership
Where the guidelines are not followed the matter is dealt with as a traditional traffic offence, where a Fixed Penalty Notice or fine compensation order is issued the fine payment goes to central government

In England and Wales, any traffic offence processed in court attracts a courts cost fee typically £15 but can be increased up to the costs of the traffic incident at the request of the crown, in Scotland this cannot be done (the relevant body can pursue these costs separately once a conviction has been secured)

    Finally,
Just because you've been stopped for a traffic offence doesn't mean you have to accept the Fixed Penalty Notice
Out of the many thousands that are rejected and proceed to court, less than 25% of them result in an actual conviction and fine which is greater than the original Fixed Penalty Notice, and an equal number never proceed to trial
