    Default Damage from pot hole

    my son was going to college this morning in his mums 08 corsa, a lorry heading in the opposite direction drove over a pot hole and a peice of the road surface flew over his side of the road bounced off the bonnet then up onto the windscreen. The sreen only has a light mark on it but the bonnet has a dent and has paint missing, needs filling and respraying.

    So my question is if you can claim for damaged wheels, tryes etc could we possibly claim for this?

    Whats peoples thoughts ?

    Might as well try it, get onto the council first if they tell you where to stick it go to CAB and contact a no-win no-fee solicitor, they'll probably have a go.

    well, i have been fighting for 6 months for the council to pay for damage to my car, on my way to work one morning they were laying tar/grit surface dreesing, i was told buy a worker to drive over what they had just finished, when i got to work i noticed there war tar all up the wing and doors on the front and tar was all over my inner arches, the stones also chipped paint on my bumper, bonnet, wings and door.poned the council and they sent me a claim form , sent it off and to this day a still fighting it. i am now taking them to court as they refuse i can prove it was them.i have had several meetings with cab, written a letter to my local councilor and mp and even wrote to the papers!!. even after all of this thay are still denying responsibility.

    so my advice to you is if you want to claim fine, but you are entering a very long, stressfull and time consuming battle. if it was me go through insurance!

    I went through the process a couple of years ago of chasing
    two wrecked tyres as a result of a pot hole. I lost
    because the council proved that they inspected the road as required (twice a year), and that was all that was required to meet there duty
    of care. The council concerned KENT COUNTY COUNCIL, are the same bunch of *#*^" that invested in Icelandic banks.

    That sounds like an accident as it was caused by the truck. Yes the pot hole played a part in it but the bigger part was played by the truck. Not a chance in my book.
